Terms of Service

These Terms of Service govern your use of this website and any order you place with Apex Threadhaus & Ink ("Apex," "we," "us," or "our"), located at 503 Prosperity Way, North Sioux City, SD 57049. By using this site, requesting a quote, or placing an order, you agree to these terms. If you do not agree, please do not use the site or place an order.

We may update these terms from time to time. The version in effect on the date you place your order governs that order.

Prices shown on this site are starting prices and are not a final quote. Final pricing depends on the specifics of your project and is confirmed in writing before production begins.

• Pricing is subject to change based on order quantity and the size and complexity of your design or artwork.
• Artwork creation and design assistance are billable services. Any such charges are itemized during the quoting process before you approve the order.
• Quotes are valid for the period stated on the quote. If no period is stated, a quote is valid for 30 days from the date it is issued.
• Pricing does not include applicable sales tax or shipping unless expressly stated.

Submitting a quote request through this site does not create a binding order. An order exists only once you have approved the final quote and, where required, submitted payment.

Payment terms are set out in your quote or invoice. Unless otherwise agreed in writing, payment is due before production begins. Online payments are processed by our third-party payment processor; we do not store your full payment card details.

We reserve the right to decline or cancel any order, including orders where pricing was listed in error, where required artwork cannot be produced to an acceptable standard, or where the request would violate these terms.

You are responsible for supplying usable artwork and for reviewing what we send back before production begins.

• All items and artwork are subject to our approval before production. We may decline artwork we cannot reproduce at an acceptable quality, or that we are not permitted to print.
• Where a proof is provided, production begins only after you approve it. Your approval confirms spelling, layout, sizing, placement, colors, and quantities.
• We are not responsible for errors present in artwork or a proof you approved, including typographical errors, incorrect sizing, or incorrect placement.
• Changes requested after approval may incur additional charges and may extend the production timeline.

You retain ownership of the artwork, logos, and other materials you supply to us. By submitting them, you confirm that you own them or hold all rights and permissions needed to have them reproduced on the products you have ordered.

You agree to indemnify and hold Apex Threadhaus & Ink harmless from any claim, demand, or cost arising from our reproduction of materials you supplied, including claims of copyright, trademark, right of publicity, or other infringement. We may decline any job we believe infringes the rights of a third party.

We may photograph completed work and display it as samples of our capabilities. If you would prefer we not show your project publicly, tell us in writing before production and we will honor that.

Once product is received via supplier, expect 4–7 day turnaround or sooner.

Production times are estimates measured from the date artwork is approved and, where applicable, from the date blank goods are received from our supplier. They are not guarantees. Supplier delays, stock shortages, carrier delays, and events outside our reasonable control may extend the timeline. If you have a firm in-hands date, tell us before you order so we can confirm whether it is achievable.

Custom decoration is a physical process with real constraints. The following apply unless we have confirmed otherwise for your specific job:

• UV printing: objects must be no more than 15.5 inches tall. All items are subject to approval before we accept the job.
• Direct-to-garment (DTG): printing on dark garments, or any print using white ink, requires a pre-treatment step, which can leave a faint mark on some fabrics.
• Color: printed and stitched colors are matched as closely as the process and substrate allow. Screen colors, fabric type, and material differences mean an exact match cannot be guaranteed.
• Customer-supplied goods: items you send us for decoration are decorated at your risk. We are not responsible for the cost of goods damaged during production, though we will tell you promptly if it happens.

We ship nationwide and offer pickup at our North Sioux City shop. Shipping charges and method are confirmed on your quote or at checkout.

Risk of loss passes to you when the order is handed to the carrier or picked up. Claims for damage in transit must be made with the carrier — please keep all packaging for inspection. Claims for shortages, loss, or non-delivery must be made within 10 days of the invoice date, as set out in our Return Policy.

Tell us as soon as possible if you need to cancel or change an order. Once production has started, or once blank goods have been ordered from a supplier on your behalf, we may be unable to cancel. In that case you remain responsible for work already completed and materials already purchased. Any charges will be itemized and explained before we invoice them.

Custom, personalized, decorated, printed, and embroidered items are final sale. Returns and defect claims are handled under our Return Policy, which forms part of these terms.

You agree not to misuse this site — including attempting to gain unauthorized access to it, interfering with its operation, or uploading files containing malware. The site's design, text, graphics, and logos are our property or used with permission, and may not be copied or reused without our written consent.

Information you submit through this site — including quote requests and uploaded artwork — is handled as described in our Privacy Policy.

Except as expressly stated in these terms or our Return Policy, this website and our products are provided without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost profits or losses arising from a missed event date. Nothing in these terms limits liability that cannot be limited under applicable law.

These terms are governed by the laws of the State of South Dakota, without regard to its conflict of law rules. Any dispute arising from these terms or an order will be brought in the state or federal courts located in South Dakota, and you consent to the jurisdiction of those courts.
